a. Introduction: Xtreme Websites® (“Xtreme,” “Agency,” “we,” or “us”) provides a comprehensive range of professional branding, graphic design, content writing, and video production services (the “Services”). This Agreement governs the relationship between the Agency and the entity purchasing these Services (the “Client,” “you,” or “your”).
b. Managed Ecosystem & Service Tiers: Services are delivered as a curated, fully managed experience for active clients. Branding products are designed to complement and enhance the Client’s primary digital infrastructure. Every project is integrated into our managed ecosystem, ensuring visual and editorial consistency across the Websites Platform.
c. Mandatory Acceptance & Electronic Consent: Access to the Branding Services and the completion of any order is strictly contingent upon the Client’s review and affirmative acceptance of these Terms.
Binding Digital Signature: By clicking “I Accept,” “Place Order,” or otherwise proceeding with a purchase in the Marketplace, Client provides an electronic signature that is the legal equivalent of a handwritten signature.
Data Collection for Verification: To ensure the integrity of this Agreement, Xtreme archives identifiable data at the time of the order, including but not limited to: IP address, the specific version of the Agreement accepted, timestamp of the order, and device metadata.
d. Effectiveness: These terms are incorporated by reference into any Service Agreement or order. They become effective on the date the order is placed (the “Effective Date”) and remain in effect until terminated.
Access to branding services is a private benefit reserved exclusively for active website and marketing clients. The Marketplace is a dynamic environment: all products, deliverables, and packages are subject to change. Xtreme reserves the right to modify package inclusions, delete products, or add new products at any time without prior notice. Each order is strictly governed by the specific package deliverables, technical specifications, and FAQs listed at the respective Marketplace URL at the time of purchase:

Production timelines do not begin until the following two requirements are met:
a. The Onboarding Form: Every order requires a product-specific onboarding form. This serves to collect unique instructions and creative requests that vary per product. To prevent ambiguity, instructions must be clear and explicit (e.g., specifying “increase size by 20%” rather than “make it bigger,” or providing Hex codes rather than “more blue”). Client is encouraged to provide reference links to similar works desired.
b. Brand Crawl™ Integration: We leverage our proprietary Brand Crawl™ software to extract brand voice and stylistic preferences from your existing digital footprint. We will automatically apply your existing Brand Crawl profile to all new branding orders. If instructions are missing or ambiguous, Xtreme reserves the right to use professional discretion based on the Brand Crawl profile.
c. Work Outside Scope: If any request on the onboarding form falls outside the purchased product’s scope, the client will be provided with a cost estimate. Any work outside the product’s defined scope will be billed extra.
Logo-Centric Design: All graphic design will be derived from the company’s existing logo. If the existing logo is of insufficient quality, Xtreme will recommend a new Logo Design project so it matches the quality of the new professional web design or marketing assets.
The “New-Build” Redesign Policy: Xtreme does not perform “tweaks” on existing third-party design files. Because we require source-file integrity to guarantee quality and cannot put our name or guarantee on poor-quality designs, any request to modify an existing design will result in a “New Design” project. We will use the old design as a reference but build a fresh, high-quality version providing all necessary formats.
Brand Cohesiveness: All designs maintain the brand’s established standards and colors for all design products.
Print-Ready Files: High-quality print files (e.g., for logos or stationery) will be provided for files that could be used for print marketing. These formats are optimized for larger applications such as car wraps, banners, or signs.
Watermarking: Initial concepts are presented with a watermark. Final unwatermarked files are released only after final written approval.
Project Specifics: Content is custom-crafted to align with the client’s unique Brand Voice and project requirements. This includes specific adherence to requested length and structure, whether the project requires long-form articles, short-form social copy, SEO-driven landing pages, marketing ad copy, or email sequences.
Plagiarism & SEO: All content is guaranteed royalty-free and 100% free of plagiarism. Content designated as “SEO Content” will include all parameters required for full search engine optimization, including keyword integration, header tag structures (H1-H4), and meta-data optimization.
Content Delivery: All final content will be provided in a standard Word (.docx) file format. Exceptions are made for long-term deliverables, such as content calendars, which may be provided in Excel or CSV formats for better data management.
Content Placement: Client is solely responsible for placing and formatting copy in its final destination (e.g., formatting email content within the Automator email builder or uploading blog posts). While some products may include placement, it remains at Xtreme’s sole discretion to assist with implementation unless explicitly stated in the product package.
Media Assets: Client is solely responsible for providing content, images, or videos needed to produce the video via the Onboarding Form. Client may request specific images from depositphotos.com by providing the link; otherwise, Xtreme will use related royalty-free assets.
The Script Phase: Xtreme will send a Final Script for review. Client may make necessary corrections to reach a final version. Once the final script is approved, it is considered final and cannot be changed.
Voiceover: Xtreme utilizes male or female voice talent or realistic AI voiceovers, depending on the specific product scope.
Review: All video concepts are watermarked. Final files are released only after final approval.
a. The Hybrid Workflow: We utilize a sophisticated “Human + AI” workflow designed to deliver premium results with maximum efficiency. While AI tools are leveraged for data synthesis, initial structural drafting, and rapid prototyping, no deliverable is ever considered “Final” without expert human intervention.
b. Dedicated Branding Supervision: Every project is overseen by a Professional Human Supervisor. This specialist is responsible for ensuring that all deliverables align perfectly with the Client’s unique brand identity and the specific instructions provided in the Onboarding Form. The Supervisor acts as the “Quality Gatekeeper,” manually refining AI-generated foundations to meet Xtreme’s professional standards.
c. Technical & Strategic Oversight: Beyond aesthetic review, Human Supervision includes:
Brand Consistency: Ensuring new assets do not conflict with existing website or marketing infrastructure.
Instruction Fidelity: Verifying that explicit requests (e.g., specific Hex codes or percentage-based scaling) are executed with 100% accuracy.
Communication Management: The Supervisor serves as the primary point of contact for all project-related inquiries through the Ticketing System, ensuring clear and professional correspondence.
d. The “AI Disclosure” Clause: The use of AI tools within Xtreme’s internal workflow is a proprietary methodology used to increase production speed and data accuracy. The use of these tools does not entitle the Client to discounts, raw AI data access, or “prompts” used during the creative process. All deliverables are billed based on the value of the final professional asset.
e. Project Continuity: Your Supervisor utilizes the data stored in your Brand Crawl™ profile to ensure that branding projects remain cohesive over time. This prevents “creative drift” and ensures that an order placed today matches the visual and editorial tone of a project completed months prior.
Concepts: Initial, distinct creative directions are provided at the start of a project. Once a Concept is selected, others are discarded and may not be used.
Revisions: Minor adjustments applied to a chosen Concept. The number of revisions is strictly limited by the package purchased in the Marketplace.
Subjective Satisfaction: “Satisfaction” is defined as meeting the technical requirements and explicit instructions provided in the Onboarding Form. No refunds are issued based on “taste” or “feeling” if the technical requirements were met.
a. Official Platform Support (Ticketing System): To ensure transparency, track resolution progress, and maintain a verifiable historical record of project data, all communications, technical inquiries, and revision requests must be submitted via the official Support Ticket system within the Client Area at XtremePlatform.com.
b. Exclusivity of Channel: No support requests or project instructions sent via Email, SMS, or Phone Calls will be accepted. All project-related communication must be documented through the ticketing system to be recognized as an official instruction or to receive a resolution. This protocol prevents data loss and ensures that your project supervisor has a centralized record of all specific instructions and feedback.
c. Response Times: Agency provides a standard response window of 24-48 hours during business days, although most inquiries are addressed significantly sooner.
d. Final Approval: All final approvals for deliverable stages (e.g., Script Approval, Graphic Concept Approval) must be logged via the ticketing system. Approvals made through unofficial channels will not be considered binding and may result in production delays.
a. Intellectual Property & Indemnification: Client unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to Xtreme are owned by the Client, or Client has secured legal permission for their use. Client agrees to hold harmless, protect, and defend Xtreme from any claim or suit arising from the use of such elements provided by the Client.
b. Performance & Revenue Disclaimers: Although Xtreme utilizes professional-grade strategies, we make no guarantees that Video Production, Graphic Design, or any other Branding Marketplace products will increase business revenue, Google search rankings, the number of inbound calls, or clicks to your website. All branding assets are provided as professional marketing infrastructure, and their commercial performance is subject to external market variables.
c. Limitation of Liability: In no event will Xtreme be liable to Client or any third party for damages, including lost profits, lost savings, or other incidental, consequential, or special damages arising from the production or use of purchased branding items.
d. Cancellation & Refund Policy: Client retains the right to cancel an order within three (3) business days of purchase to receive a refund, subject to a 20% processing fee. After this 72-hour window, all monies paid are non-refundable. In the event of a refund within the eligible window, any production services already initiated will be billed in full, and the final files for that specific progress will be released to the Client.
e. Right to Additional Services: Client may request additional web design, web development, creative services, or custom automations at any time. Such requests will be treated as independent projects and will be quoted separately from existing Marketplace packages.
